📜 TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of the communication services offered by Tellimon Inc. (“Tellimon”, “we”, “our”, “us”). By creating an account, accessing our portal, using our API, purchasing numbers, or using any Tellimon service, you agree to these Terms.

If you do not agree, do not use our Services.


1. DEFINITIONS

  • “Services”: All telecommunication and cloud communication services offered by Tellimon, including virtual numbers, SMS, SIP trunking, outbound calling, inbound calling, routing, CPaaS, cloud PBX, API services, number porting, and related tools.

  • “Customer”, “You”: The person or business using Tellimon Services.

  • “DID / Number”: Any geographic, national, mobile, toll-free, or UIFN telephone number provided by Tellimon.

  • “Account”: Your Tellimon user profile, credentials, and service profile.

  • “KYC / Verification”: Identity and document checks required by telecom regulations.

  • “Content”: Any data transmitted through the Service, including calls and messages (excluding call audio, unless logged by customer).

  • “Carrier”: Underlying telecom operators used to provide the Services.


2. ELIGIBILITY

To use Tellimon:

  • You must be at least 18 years old

  • You must provide accurate account information

  • You must comply with all applicable telecom and data laws

  • Businesses must be legally registered

We reserve the right to decline service for regulatory, security, or operational reasons.


3. DESCRIPTION OF SERVICES

Tellimon offers:

  • Virtual numbers in 150+ countries

  • SIP trunking (inbound/outbound)

  • Cloud PBX & call routing

  • 2-Way SMS & messaging services

  • CPaaS APIs (SMS, Voice, Call Control, etc.)

  • PSTN Replacement & Local Termination

  • Call analytics and reporting

  • Number porting (where available)

Service availability depends on:

  • Local telecom regulations

  • KYC approval

  • Carrier routing conditions

  • Geographic restrictions

Tellimon may update or modify features at any time.


4. ACCOUNT REGISTRATION

You must create an account to use Tellimon Services. You agree to:

  • Keep login credentials secure

  • Maintain accurate profile, billing, and contact information

  • Notify Tellimon of unauthorized access immediately

You are responsible for all activity under your account.


5. KYC, DOCUMENTS & COMPLIANCE

To activate numbers or services, you must complete KYC when required. This may include:

  • Government ID

  • Proof of address

  • Business registration documents

  • End-user information

  • Service descriptions

Tellimon may suspend or terminate services if:

  • KYC is not completed

  • Documents are invalid or fraudulent

  • Regulations prohibit the requested usage

  • Suspicious activity is detected


6. ACCEPTABLE USE POLICY

You agree NOT to use Tellimon for:

6.1 Illegal activities

Including: fraud, harassment, scams, impersonation, threats, extortion, or violation of telecom laws.

6.2 Prohibited industries

Unless explicitly authorized:

  • Investment scams

  • Cryptocurrency cold calling

  • Gambling or betting

  • Adult services

  • Lottery promotions

  • Phishing or spoofing

  • Hate speech

6.3 Spam & robocalling

  • No auto-dialer blasts

  • No bulk robocalls without consent

  • No spam SMS

  • No misleading caller ID

  • No prerecorded advertisements (unless permitted by law)

6.4 Emergency misuse

You may not falsely call emergency services.

6.5 Security violations

Attempting to reverse engineer, hack, scrape, attack, or overload Tellimon systems.

Tellimon may block traffic, suspend service, or terminate your account if misuse is detected.


7. TELECOM REGULATIONS & SERVICE LIMITATIONS

Telecom laws vary by country. Tellimon may:

  • Require additional documents

  • Restrict personal calling in certain countries

  • Block traffic types prohibited by local law

  • Limit outbound traffic patterns

  • Disable services that violate carrier policies

Call and SMS delivery is not guaranteed due to factors outside our control (carrier outages, local restrictions, handset behavior, etc.).


8. PRICING & BILLING

8.1 Fees

Fees apply to:

  • Virtual numbers

  • Setup or activation fees (if any)

  • Monthly recurring charges

  • Inbound and outbound calls

  • SMS traffic

  • Porting fees

  • API usage

  • Regulatory surcharges

  • Emergency calling fees

8.2 Wallet & Prepaid System

Tellimon operates on a prepaid model.
Services require sufficient wallet balance.

8.3 Automatic Suspension

If your balance reaches zero, services may be suspended immediately.

8.4 Taxes

Local taxes, VAT, or GST may apply depending on your jurisdiction.

8.5 Price Changes

Tellimon may update prices at any time and will notify customers where required.


9. REFUNDS

Refunds are issued only when legally required or at Tellimon’s discretion.

No refunds for:

  • Used or partially used services

  • Fraudulent, abusive, or policy-violating accounts

  • Carrier-level issues beyond our control

  • Regulatory restrictions preventing number usage

Unused wallet balances may be refundable after review.


10. NUMBER OWNERSHIP & PORTING

Virtual numbers issued by Tellimon:

  • Are owned by the carrier or national regulator

  • Are licensed to you for duration of your subscription

  • May require KYC updates to remain active

  • May be reclaimed if unused or unpaid

  • May be ported where allowed by law

Tellimon cannot guarantee porting in all regions.


11. DATA PROCESSING & PRIVACY

Your privacy is governed by our:

12. SERVICE AVAILABILITY & UPTIME

Tellimon aims to provide high availability through redundant global infrastructure.
However, we do NOT guarantee:

  • 100% uptime

  • Delivery of every call or SMS

  • Zero interruptions or latency

  • Full availability in all countries

Telecom services inherently depend on external carriers and infrastructure.


13. SUSPENSION & TERMINATION

Tellimon may suspend or terminate services if:

  • You violate these Terms or laws

  • You fail to maintain sufficient wallet balance

  • Fraudulent or high-risk traffic is detected

  • KYC information is incomplete or invalid

  • Carriers or regulators require suspension

  • Emergency or safety reasons demand immediate action

You may terminate your account anytime by contacting support.


14. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

  • Tellimon is not liable for indirect, incidental, special, or consequential damages

  • Tellimon’s total liability is limited to the amount paid to us in the last 60 days

  • We are not responsible for losses due to external carrier issues, outages, spam blocking, regulation, or fraudulent use of your credentials


15. INDEMNIFICATION

You agree to indemnify and hold Tellimon harmless from any claims, damages, fines, or costs arising from:

  • Your use of the Services

  • Regulatory violations

  • Unlawful traffic

  • Breach of these Terms

  • Misuse of numbers or caller IDs


16. GOVERNING LAW

These Terms are governed by the laws of the:

State of California, United States,
without regard to conflict-of-law principles.

Any disputes shall be handled in courts located in San Francisco, California.


17. CHANGES TO TERMS

Tellimon may update these Terms at any time.
If material changes occur, we will notify you via email or dashboard.

Continued use of the Services means you accept the updated Terms.
